The Hire Hub is a trading entity wholly owned by Systanet Limited, company number 3882427, registered in England and Wales. Systanet Limited's registered office is The Old Chapel, Faulkland, Bath, UK, BA3 5XD. Where reference is made to The Hire Hub, it is also, by implication, made to Systanet Limited. "The Hire Hub Website" means content, software, facilities and services available within the domain and sub-domains of thehirehub.co.uk.

Membership

Use of The Hire Hub Website is restricted through membership. Members under 18 years old can use The Hire Hub Website only under the supervision of a parent or guardian. If you are becoming a member as a business or organisation, you must have the authority to bind that business or organisation to this agreement.

When you join as a member you must choose a Username and a Password. You agree to use every effort to keep your Password safe and not to disclose it to any other person. You agree not to register for more than one membership account. You are responsible for your membership account and all trades, interactions, dialogues and other actions using that account. You shall not transfer or sell your account to anyone. You shall also not permit, either directly or indirectly, any other person to use your Username or Password.

The Hire Hub is not an intermediary in any hire agreements. The Hire Hub Website is simply a place which allows registered users to interact and trade. The Hire Hub does not hire or own the items listed. Members own the equipment they hire to other members and the contractual hire agreement rests between them. The Hire Hub does not hold any responsibility for any aspect of any hire agreement made by use of this site including but not limited to delivery, price, quality, safety, or terms.

You agree to use The Hire Hub Website in good faith with the intention of lawfully entering into hire agreements.

The Hire Hub does not endorse any item listed as being as described and has no control over the quality, safety or other aspect of the item. The Hire Hub takes no responsibility for ensuring that any hire agreements made conclude as intended, nor for legal infringements that hire agreements may incur. You accept sole responsibility for the legality of your actions under laws applying to you. Certain items (such as CDs or DVDs containing music, games, videos, etc.) may have rental restrictions on them and you must check the legality of potential rental contracts before offering such items. You must not offer rental of, or hire, any items which we do not permit on The Hire Hub Website.

Listings and messages sent between users must not contain contact information either directly or indirectly, or encourage the hiring of items outside of The Hire Hub Website. Listings and messages of this nature circumvent The Hire Hub's fees and increase the risk of fraud for both Hirers and Owners. In circumstances where insufficient detail can be presented in a listing then other sources of information can be referenced provided the user is encouraged to return to The Hire Hub Website to make a booking.

Members agree to use their best endeavours to:

• Only offer items for hire that they wholly own, that they are legally entitled to hire, and that are not on the prohibited items list
• Act lawfully and responsibly towards Hirers of their items
• To ensure the safety of other members
• Not to misrepresent the availability, quality, function, or other description of items offered.
• Pay fees to The Hire Hub as and when they become due.

The Hire Hub shall use all reasonable endeavours to act in good faith and shall not knowingly or wilfully distribute false information. You are responsible for checking such information and for your actions arising from such information. You agree that charges are made for the information supplied, whatever its validity, accuracy or usefulness. The Hire Hub shall not be liable for any inaccuracies, deletions, omissions, or errors in the information within The Hire Hub Website. The Hire Hub is not responsible for any virus transmitted by you or third parties using The Hire Hub Website.

You agree not to submit any information that:

• Is untrue, misleading, or could be readily misinterpreted as such.
• Is vulgar, obscene, racially, ethnically, or religiously objectionable.
• Is abusive, threatening, or damaging to any individual, company or organisation.
• Is contaminated or contains corrupted material or intends to cause damage or corruption (such as a virus).
• Encourages the circumvention or manipulation of The Hire Hub's fee structure, the billing process, or fees owed.
• Intends to adversely affect the performance or availability of the service to other users.
• Is not specifically for the purposes of entering into hire agreements with other members through the use of The Hire Hub Website.
• Offers services that are illegal or may causes offence to others.

In using The Hire Hub Website you agree that The Hire Hub may use any information supplied for the purposes of achieving rental agreements between owners and hirers. You also agree that The Hire Hub may amend, correct, adjust, translate, publish and distribute such information in whole or in part, and without consideration or compensation.

Where you willingly provide information on your experience of another member you agree to do so fairly and justifiably. You agree that The Hire Hub can record, use, and display ratings describing others' experience of you or your Company's performance, or general description. You also agree that such ratings can be constructed in whole or part, by reference to third party experience of you, whether subjective or objective.

Payment

Charges for use of The Hire Hub Website are as described in the fees section.

You agree to pay the charges made to your account in full, regardless of the outcome of hire agreements made using The Hire Hub Website. Fees payable to The Hire Hub are for the service and information supplied. Fees are not refundable for whatever reason (including but not limited to failure, in part or whole, of the hire agreement made between members).

Any promotion credits (such as for member referral) to your account are time-limited, non-transferrable, and non-redeemable. Any portion of a promotional credit that is not used after 12 months shall be deemed expired and your account balance will be adjusted accordingly..

Ownership

You may not re-use, make copies of, distribute, re-sell, reproduce, nor publish, all or any part of The Hire Hub Website or the information contained within The Hire Hub Website without the express written permission of The Hire Hub.  

The Hire Hub is the owner of all intellectual property rights (including but not limited to designs, copyrights, intellectual processes, software, and know-how), other than the licenced re-use of proprietary software within The Hire Hub Website. Nothing in these terms shall be taken as granting you, or any third party, use of such intellectual property. .

Liability

Where limitation of liability is restricted by law, The Hire Hub's liability, and that of its directors, is limited to the extent permitted by law.

You agree to indemnify The Hire Hub against action arising from any third party claim, damage, or compensation. Should you have any right, claim or action against any other user arising from that user's use of the Site, you agree to pursue such right, claim or action independently of The Hire Hub. You agree to release The Hire Hub (and its partners, contractors, subsidiaries, directors, and employees) from all claims, liability, damages, losses, cost, including legal fees, arising from or connected with such right, claim or action.

Service Level

You agree that The Hire Hub may, at its own discretion, remove your access to the The Hire Hub Website without compensation.

The Hire Hub does not guarantee continuous, uninterrupted access to The Hire Hub Website. You agree that The Hire Hub Website is provided "as is" and as and when available. You also agree that to the legal extent permissible The Hire Hub excludes all implied warranties, terms and conditions, including without limitation any terms as to performance or quality.

General

You consent that The Hire Hub can amend these terms and conditions from time to time and that your use of The Hire Hub Website is against the terms prevailing at the time.

These terms and conditions are governed by the laws of England and the jurisdiction of the English Courts.
